Terms of Service

1 Agreement to these terms

These Terms of Service ("Terms") govern your school's use of RADevo ("the Service"), operated by Ash Radford trading as RADevo ("RADevo", "we", "us", "our"), based in England, United Kingdom.

By activating a RADevo account and allowing students or staff to use the Service, the school ("you", "the School") agrees to be bound by these Terms. If you do not agree, you must not use the Service.

These Terms form a legally binding agreement between RADevo and the School. Individual student and teacher users use the Service under the School's agreement.

2 The Service

RADevo is an online educational revision quiz platform designed for secondary schools. The Service includes:

• A student-facing quiz and revision portal with activity-based question types
• A teacher dashboard for setting homework, creating assignments, and monitoring class progress
• AI-powered class performance analysis (where included in your subscription tier)
• AI-powered quiz bank generation (where included in your subscription tier)
• Student progress tracking, streaks, points, and avatar-based engagement features

RADevo reserves the right to update, improve, or modify the Service at any time. We will endeavour to notify schools of material changes in advance.

3 Subscription tiers and pricing

RADevo is offered on the following subscription tiers:

Prices are quoted exclusive of VAT. An invoice will be issued on subscription activation. Subscriptions are annual and non-refundable except where RADevo fails to deliver the agreed service.

RADevo reserves the right to change pricing on renewal with a minimum of 30 days' written notice.

4 Trial period

RADevo may offer a free trial period at its discretion. During a trial, the School has access to the agreed features at no cost. At the end of the trial period:

• Access to the platform will be suspended unless the School activates a paid subscription
• Student data collected during the trial will be retained for up to 30 days, after which it may be deleted

RADevo is not obligated to offer a trial to any school.

5 School responsibilities

By using RADevo, the School agrees to:

• Ensure that appropriate consent or lawful basis exists for student data to be processed by RADevo, in accordance with UK GDPR and the school's own data protection obligations
• Use the Service only for its intended educational purposes
• Not share login credentials or deployment URLs with individuals outside the School without authorisation from RADevo
• Notify RADevo promptly of any suspected security breach or unauthorised access
• Ensure that teacher accounts are used only by authorised members of staff
• Not attempt to reverse engineer, copy, or redistribute any part of the RADevo platform or its question content

6 Acceptable use

The Service must not be used to:

• Harass, bully, or harm any student or staff member
• Upload or generate content that is offensive, discriminatory, or inappropriate for an educational setting
• Attempt to circumvent security measures or access data belonging to other schools
• Use AI generation features to produce content unrelated to the school's educational curriculum

7 AI features — fair use

Subscriptions that include AI-powered features (AI Analysis and AI Creation tiers) are subject to a fair use limit of 20 AI calls per month per school, shared across all teacher accounts. This limit resets on the 1st of each calendar month.

RADevo reserves the right to adjust this limit and will provide at least 30 days' notice of any reduction.

AI-generated content is produced automatically and should be reviewed by the teacher before use. RADevo does not guarantee the accuracy or suitability of AI-generated quiz questions and accepts no liability for errors in AI-generated content.

8 Intellectual property

All software, design, branding, and hardcoded question content within RADevo is the intellectual property of RADevo and may not be copied, reproduced, or distributed without written permission.

Quiz content created by teachers using RADevo's AI generation tools remains the property of the School. RADevo does not claim ownership of teacher-created or AI-generated content produced within the platform.

The RADevo name, logo, and "Where learning evolves" tagline are trademarks of RADevo. Use of these marks without permission is prohibited.

9 Service availability

RADevo aims to maintain high availability of the Service but does not guarantee uninterrupted access. Planned maintenance will be communicated in advance where possible. RADevo is not liable for any loss arising from temporary unavailability of the Service.

RADevo is hosted on Google's infrastructure. Outages caused by Google's services are outside RADevo's control.

10 Limitation of liability

To the maximum extent permitted by law:

• RADevo's total liability to the School shall not exceed the amount paid by the School in the 12 months preceding the claim
• RADevo is not liable for indirect, consequential, or incidental losses arising from use of the Service
• RADevo is not liable for any loss arising from the School's failure to comply with its own data protection obligations

Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

11 Termination

Either party may terminate the subscription at the end of the annual term by providing written notice at least 30 days before the renewal date. No refund is due for early termination within an annual term.

RADevo may terminate the subscription immediately in writing if the School materially breaches these Terms and fails to remedy the breach within 14 days of notice.

On termination, the School's access to the platform will be suspended. Student data will be retained for up to 12 months before deletion, unless the School requests earlier deletion.

12 Governing law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13 Changes to these terms

RADevo may update these Terms from time to time. Schools will be notified of material changes by email with at least 30 days' notice. Continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms.
